LAWSUIT – ADVANTAGES

The lawsuit covers all the claims of the victim and his family members, without any of the restrictions of the Amicable Settlement.

In every case of a traffic accident, whether fatal or not, the process of claiming monetary compensation through a well-structured lawsuit before the competent court ensures the restoration of a series of important and admittedly reasonable and existing monetary claims, not only for the injured driver and/or passenger, but also for their family members, who, in most cases, are said to experience, in parallel and sometimes equally painfully, all or a large part of the tragic consequences of a (fatal or non-fatal) traffic accident.

More specifically, by filing a lawsuit in the competent court, the victim and his family are entitled to and must claim in court, among a host of other items, the following substantial financial claims:

Expenses for the full repair of material damage suffered by the vehicle as a result of the traffic accident.

Compensation for the reduction in the commercial value of the vehicle as a result of the traffic accident.

Payment of the full commercial value of the vehicle to the owner in the event of Its total destruction.

Hospitalization and medical expenses for the injured driver or passenger.

Expenses for the medical care of the injured (e.g., medicines, consumables, special medical supplies, products, etc.).

Expenses for transporting the injured from the scene of the accident to the hospital.

Special dietary expenses.

Full expenses for each trip of the injured person to the hospital, as required after the accident, for systematic re-examination of the injury by the attending physicians, until full recovery.

Compensation for the driver and passengers for the destruction of personal items in the accident (clothing, glasses, watches, mobile phone, laptop, other portable electrical devices, loss of money, credit or other bank cards during the fall, etc.).

Remuneration of a person or persons(professional nurse or private individual, e.g. a relative, appointed with or without an employment contract), for supervising and providing all kinds of care services to the injured driver or passenger.

Compensation for loss of income (salary or pension benefits of the injured driver or passenger) in the event of temporary or permanent incapacity – inability of the injured person to work due to injury from the traffic accident (all types of lost earnings of the victim and his family due to the accident).

Full financial compensation for the moral damage suffered by the victim and his family members because of the traffic accident.

Funeral expenses and full compensation for the mental anguish suffered by the family members of the deceased driver or passenger in the event of a fatal traffic accident.

Any other material or immaterial damage caused to the victim or his family because of the traffic accident.

However, it should be made clear that the above sums of money, i.e. the financial compensation of the victim and his family for any material, positive, consequential, moral, and/or any other damage or injury of any kind, is only possible if it has been previously requested by filing a properly structured and well-drafted statement of claim before the competent court, both on behalf of the victim(s) and on behalf of their family members, who may have suffered and continue to suffer direct, indirect, or even completely reflexive consequences from the traffic accident and as a result of it.

A necessary and essential condition for the effective judicial award of the above amounts, as well as for the full civil justice and compensation of the victims and their families, is the formulation and filing of a lawsuit with a complete, thorough, and well-founded description of the historical and factual circumstances of the traffic accident.

This description must be clear, justified, and extremely precise. At the same time, a well-structured and legally complete legal basis is required to ensure the correctness and validity of the lawsuit.

Furthermore, it is necessary to include a complete and detailed framework of claims. These claims must be calculated with thorough mathematical precision so that they directly lead to the full reimbursement of all expenses and financial costs of any kind incurred by the victims and their families.

There should be no upper financial limit or other restrictions whatsoever, provided that the amounts are directly causally related and consistent with the actual historical circumstances of each traffic accident under consideration.

Finally, all the evidence must always identify and personalize the specific nature of the case in order to ensure full judicial redress for the victims.
