It is common for one of the two soon-to-be spouses to be a foreigner. In this case, it is important to be aware of the specific requirements regarding the necessary documents and the overall marriage procedure.
Specifically, the issue arises mainly in the following points when one of the spouses does not have Greek citizenship:
- Declaration of Place of Residence:
One of the prerequisites for issuing a civil marriage license by the Greek authorities is that the spouses have lawful residence in Greece. However, in cases where one of the spouses is a foreigner, it is quite common that their residence is not within the Greek territory. In this case, a third party (even the other spouse) must declare that they host the foreigner at their residence, so the requirement of having residence in Greece is fulfilled.
- Declaration of No Impediment to Marriage:
Among the documents required from both spouses for the issuance of the civil marriage license is a declaration stating that there is no impediment to their marriage under the provisions of the Civil Code. Especially in the case where at least one spouse is a foreigner, this declaration must be made at the Embassy of their country in Greece, according to the specific requirements of each Embassy. Subsequently, this declaration must be certified by the competent department of the Ministry of Foreign Affairs so that it can be used by the Greek authorities for the issuance of the marriage license.
- Issuance and Payment of the Required Fee:
Regarding the fees required for the marriage, which each spouse must issue through TaxisNet, if the foreign spouse does not have the corresponding codes, the other spouse can issue both fees using their own codes, indicating that one is issued for the use of the future spouse.
- Documents from Abroad:
In any case, all documents required for the civil marriage originating from abroad must bear an official translation into Greek, as well as the Apostille certification where necessary.
