05.09.2014 – The law firm “Spilios Spiliopoulos and Associates” is taking action to file an administrative appeal before the competent Administrative Court, with the aim of annulling the terms of the PPC’s Public Open Tender for the selection of a Contractor for the supply of equipment.
The Court ruled that the terms of the tender in question contravene both domestic and Community law, as they infringe the principles of free competition, equal treatment, and non-discrimination. In particular, it was held that all of the contested conditions were in complete contradiction with Directives 2004/18/EC and 2004/17/EC, which require the protection of free and undistorted competition and the opening up of markets. This is because the criteria for awarding contracts through public tenders are interpreted in the light of the principle of competition, an interpretation consistent with the relevant Community Directives, which are based on the opening up of public procurement markets to competition.
